1. SERVICES PROVIDED
The Intuitive Brush offers the following services and products:

2. IMPORTANT DISCLAIMERS
Not Medical, Psychological, or Legal Advice
The services I provide, including but not limited to psychic readings, aura readings, creative healing sessions, and intuitive artwork, are for spiritual guidance, creative expression, and personal growth only.
I am NOT:
A licensed medical doctor, psychologist, psychiatrist, or therapist
Qualified to diagnose, treat, cure, or prevent any medical or psychological condition
Able to provide medical, psychological, legal, or financial advice
Important
Do not discontinue any prescribed medications or treatments based on information received in sessions
Always consult qualified healthcare professionals for medical or psychological concerns
My services are not a substitute for professional medical, psychological, legal, or financial advice

Creative Healing vs. Art Therapy
While I hold a Bachelor of Science in Art Therapy and Psychology and a Master's in Art Education, I am not a licensed art therapist. Earth Medicine Sessions and other creative healing offerings draw from art therapy principles and psychological understanding but are offered as creative healing sessions, not licensed art therapy or mental health treatment.
Psychic Medium Services
Psychic medium services, including aura readings and intuitive guidance, are provided for entertainment and spiritual exploration purposes. Results are not guaranteed, and interpretations are subjective. You are responsible for your own choices and decisions.
3. RELEASE OF LIABILITY & ASSUMPTION OF RISK
By using The Intuitive Brush services, you acknowledge and agree to the following:
Voluntary Participation: Your participation in all sessions, programs, workshops, and services is entirely voluntary. You assume all risks associated with your participation.
No Guarantees
No specific results are guaranteed from any service, session, or product
Psychic readings, aura readings, and intuitive guidance are subjective interpretations based on spiritual practices
Creative healing sessions support personal growth and creative expression but are not medical or psychological treatment
Individual results, experiences, and outcomes vary
The effectiveness of any service depends on multiple factors including your openness, participation, and personal circumstances
Personal Responsibility
You are solely responsible for:
Your own physical, mental, emotional, and spiritual health, safety, and well-being
Any decisions or actions you take based on sessions, guidance, or information received
Seeking appropriate professional help for medical, psychological, legal, or financial matters
Determining whether services are appropriate for your personal situation and needs
Your own interpretation and application of any guidance or insights received
Release of Liability: To the fullest extent permitted by law, you release and hold harmless Christine Gibbins, The Intuitive Brush, and any affiliated parties from any and all claims, damages, losses, liabilities, or injuries arising from or related to your participation in services, including but not limited to: physical, emotional, psychological, or spiritual effects or outcomes; decisions made based on guidance, insights, or information received during sessions; use of creative materials, practices, or recommendations provided; any technical issues, service interruptions, or scheduling conflicts; interpretation or application of any information provided; and any outcomes or lack of outcomes from participation in services.
Limitation of Liability: In no event shall The Intuitive Brush or Christine Gibbins be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of services. The maximum liability of The Intuitive Brush and Christine Gibbins for any claim arising out of or related to services shall not exceed the amount you paid for the specific service giving rise to the claim.
Contraindications & Exclusions
Services may not be appropriate for individuals who are:
Currently in mental health crisis or experiencing suicidal ideation
Diagnosed with severe or untreated mental health conditions without professional oversight
Under the influence of drugs or alcohol
Experiencing active psychosis, dissociation, or detachment from reality
Without legal capacity to provide informed consent
Unwilling to take personal responsibility for their choices and well-being
If any of these apply to you, please seek appropriate professional help before booking services. By booking services, you confirm that none of these contraindications apply to you.
Informed Consent: By booking and participating in any service, you confirm that you have read and understood this entire Terms of Service, understand the nature of the services being provided, acknowledge the disclaimers and limitations stated herein, voluntarily assume all risks associated with participation, and release The Intuitive Brush and Christine Gibbins from liability as stated above.
4. CANCELLATION & REFUND POLICY
Session Cancellations
All cancellations or rescheduling requests must be made at least 24 hours in advance
Cancellations with less than 24 hours notice will result in forfeiture of the session
No-shows (failure to attend scheduled session without notice) will result in forfeiture of the session
Sessions can be rescheduled with at least 24 hours advance notice, subject to availability
Genuine Emergencies: Genuine emergencies (serious illness, family emergency, etc.) will be considered on a case-by-case basis. Please contact me as soon as possible if an emergency arises.
Session Packages: Unused sessions in packages can be rescheduled with adequate notice. Sessions must be used within 6 months of purchase unless otherwise agreed. Missed sessions without adequate notice are forfeited and not refundable.
Workshop Cancellations
Workshop registrations can be transferred to any future workshop of equal or lesser value
Transfers must be requested at least 7 days before the scheduled workshop
No refunds are provided for workshop registrations
Workshop registrations never expire — you can use them for future workshops indefinitely
Workshop Cancellation by The Intuitive Brush: If a workshop is cancelled due to insufficient enrollment or unforeseen circumstances, participants will receive a full refund of registration fee OR credit toward any future workshop or service.
Product Sales
Custom Artwork: All custom artwork sales are final once the commission is accepted and work has begun. Consultations are non-refundable. If you are dissatisfied with the final artwork, please contact me to discuss options.
Physical Products: All sales are final unless the product arrives damaged. Contact me within 7 days of delivery with photographic evidence. I will replace damaged items or issue a refund at my discretion.
Digital Products: All sales of digital products (guided meditations, digital gift certificates, etc.) are final. No refunds will be provided for digital products once delivered.
Inner Forest Program
Full refund if cancelled 30+ days before program start date
50% refund if cancelled 14-29 days before program start date
No refund if cancelled less than 14 days before program start date
No refunds after the program has begun
Transfers: If you cannot attend the program, you may transfer your registration to the next program cohort if space is available. Transfers must be requested at least 14 days before the program start date.
Gift Certificates: Gift certificates are non-refundable, expire 1 year from date of purchase, can be used toward any service or product of equal or lesser value, and cannot be redeemed for cash.
Payment Plans: If you are on a payment plan and wish to cancel, you are responsible for any payments already made. Payments already made are non-refundable. If services have already been rendered, remaining payments are still due.
Refund Processing: All approved refunds will be processed within 7-14 business days using the original payment method. Please allow additional time for your financial institution to process the refund.
Disputes: If you have concerns about a charge or service, please contact me at christine@theintuitivebrush.com before disputing the charge with your payment provider. I am committed to resolving issues directly and fairly.
5. CLIENT CONDUCT & EXPECTATIONS
Respectful Behavior
All clients are expected to:
Treat me and other participants with respect and kindness
Arrive on time for scheduled sessions or workshops
Participate with openness and good faith
Refrain from disruptive, abusive, or inappropriate behavior
I reserve the right to refuse service to anyone for any reason, and to terminate services immediately if a client behaves inappropriately, disrespectfully, or abusively. No refunds will be provided for services terminated due to client misconduct.
Session Expectations
Your Responsibilities:
Be present and engaged during sessions
Complete any pre-session requirements (consultations, forms, etc.)
Provide accurate information when booking
Have necessary materials ready for virtual sessions
Ensure a quiet, private space for virtual sessions
Technical Requirements for Virtual Sessions: Stable internet connection, working camera and microphone, Zoom or other specified platform access, and a quiet, private environment. I am not responsible for technical difficulties on your end. Sessions missed due to your technical issues are subject to the standard cancellation policy.
6. INTELLECTUAL PROPERTY
Client Work: Artwork created specifically for you (Divine Feminine Drawings, Intuitive Energy Paintings, auragraphs) becomes your property upon full payment. You may use your personal artwork for personal, non-commercial purposes. You may not reproduce, sell, or distribute your artwork commercially without written permission.
Workshop & Session Materials: Creative work you make during sessions and workshops belongs to you. Course materials, handouts, and guided meditations provided by The Intuitive Brush remain my intellectual property.
Website Content: All content on theintuitivebrush.com, including text, graphics, logos, images, and software, is my property and protected by copyright laws. You may not reproduce, distribute, or create derivative works without written permission.
Photography & Testimonials: By participating in services, you may be asked for permission to photograph your creative work for portfolio or marketing purposes, or to use your testimonial or feedback in marketing materials. You always have the right to decline, request removal at any time, or remain anonymous. I will never use your image, name, or testimonial without your explicit written consent.
7. DISCLAIMER OF WARRANTIES
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
I do not warrant that services will be uninterrupted, timely, secure, or error-free; that results from services will meet your expectations; that the quality of services will meet your requirements; or that any errors will be corrected.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Intuitive Brush, Christine Gibbins, and any affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of services, your violation of these Terms, your violation of any third-party rights, or any decisions or actions you take based on services received.
9. SEVERABILITY
If any provision of this Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
10. GOVERNING LAW & DISPUTE RESOLUTION
Governing Law: This Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
Dispute Resolution
1. Informal Resolution: I encourage you to contact me first at christine@theintuitivebrush.com to resolve the matter informally.
2. Mediation: If informal resolution fails, disputes may be submitted to mediation before pursuing legal action.
3. Jurisdiction: Any legal action must be brought in the state or federal courts located in Clark County, Washington.
Waiver of Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
11. ENTIRE AGREEMENT
This Terms of Service, together with the Privacy Policy, constitutes the entire agreement between you and The Intuitive Brush regarding the use of services and supersedes any prior agreements.
12. ACKNOWLEDGMENT
BY USING THE INTUITIVE BRUSH SERVICES, BOOKING A SESSION, PURCHASING A PRODUCT, OR CHECKING THE "I AGREE" BOX, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS TERMS OF SERVICE AND THE SEPARATE PRIVACY POLICY.
